Do You Need a Permit to Fell a Tree?
In South Africa, certain tree species are protected under the National Forests Act (Act 84 of 1998). Felling, damaging or removing a protected tree without a permit is illegal and can result in heavy fines or imprisonment.
Protected Tree Species
South Africa has a list of protected tree species that includes many indigenous trees. Common protected species found in Gauteng include:
- Marula (Sclerocarya birrea)
- Yellowwood (Podocarpus spp.)
- Wild Fig (Ficus spp.)
- Karee (Searsia lancea)
- Shepherd's Tree (Boscia albitrunca)
How to Apply for a Permit
- Identify the tree species (consult an arborist if unsure)
- Contact the Department of Forestry and Fisheries (DFFE)
- Submit a formal application with photographs and motivation
- Wait for inspection and approval (can take 4-8 weeks)
When You Don't Need a Permit
Permits are generally not required for:
- Exotic (non-indigenous) species like Pine, Eucalyptus, Jacaranda
- Dead trees that pose an immediate safety hazard
- Trees declared invasive under NEMBA
